The website www.acquirafresh.ro ("Website") is the property of Acquira Fresh SRL with its registered office in Strada soseaua Virtutii no 13, bl R5B, sc1, et 5, ap 23 Bucharest sector 6, registered at the Trade Register under no. . Acquirafresh specializes in selling, among other things, food. Acquirafresh sells Products through the Website, as well as in stores across the country.

 The products and services promoted and offered for sale on the Website will be referred to during these Terms and Conditions as "Products".

Website User

The Website user must:

  Creating an Account by the Customer

In this case, after the Customer will add a Product to the shopping cart and access (in that cart) the "NEXT STEP" button, the Customer will be asked for the e-mail address based on which the Customer will automatically create an Account by the Website system. The password for this Account will be chosen at random by the Website.

Acquirafresh will confirm to the Client the creation of the Account by sending to the Client (at the e-mail address indicated by the Client in order to create the respective Account) an e-mail in this respect (within the respective e-mail, Acquirafresh will communicate to the Client link through which the Customer will be able to change the password chosen at random by the Website). If the Customer does not enter the e-mail address, the Account will not be created and, therefore, the order will not be completed. If the Customer enters the e-mail address, but then the Customer does not complete the order, the e-mail address and other data provided by the Customer will not be stored by Carrefour, and the account created will be deleted automatically.

If the respective order is completed, the Customer has the possibility to choose between keeping the Account (this turning into an Account under the conditions of point a) above) or giving up this Account.

The customer is responsible for maintaining the confidentiality of his account data, in particular the password and bank details associated with it.

This information is necessary for order management and business relations between Acquirafresh on the one hand, and the Customer, on the other.

If the password is lost or forgotten, it can be regenerated by accessing the "My Account" box and entering the e-mail address, and a password will be sent by e-mail. The password is strictly confidential.

Customer is solely responsible for maintaining the security and confidentiality of the Account and password and is responsible for all activities and conduct of itself or any other person acting on the Products through the Account. Customer agrees to notify Acquirafresh immediately of any suspicion of unauthorized use of the Account or of any suspicion of a possible security breach. Acquirafresh or its representatives will not be liable for any loss or damage of any kind that may arise as a result of the use by another person of the Account, with or without the permission of the Customer. Customer is liable for any loss caused by Acquirafresh or any third party as a result of the use of the Account by another person.

The password will not be used to make online payments. The password will be used only for the purpose of registering the Customer and creating an Account in order to place online orders through the Website.

Customers are obliged to provide true, accurate and complete data as indicated in the registration form and to renew, whenever necessary, the registration data to be true, accurate and complete at any time.

In the event that the Customer provides information that is not in accordance with reality, inaccurate or incomplete, Acquirafresh reserves the right to suspend or terminate the Account and to refuse all current or future attempts to use the services of the Website, without any compensation. to the Customer.

These conditions must also be met in case of registration of Customers' participation in the contests / promotions organized and presented on the Website by Acquirafresh, contests / promotions that will be governed by separate regulations.

Product Availability and Offer Validity

Product Offers and prices displayed on the Website are valid as long as they are visible on the Website and within the available stock.

The valid products and offers will be signaled on the Website by the presence of the "Add to cart" button, next to them. The simple fact of adding Products to the cart does not represent the automatic validation of the order, there is the possibility that between the moment of adding the Product to the cart, and the moment of validation of the Order by the Customer, the Product / Products become unavailable.

If after the addition of a Product in the cart, it becomes unavailable, the Customer will be duly informed.

Acquirafresh may offer the Customer options for Products similar to the Product that has become unavailable. The customer can choose to add one of the similar Products presented by Acquirafresh to the shopping cart or he can refuse the Products presented by Acquirafresh.

Product Prices

The prices of the Products presented on the Website are expressed in RON and have all taxes included, except for transport costs. The transport costs will be brought to the Client's knowledge before the moment of completing the order.

The applicable prices are those displayed on the Website at the time of validation of the order by the Customer. The prices include VAT, and all legal changes regarding the amount of this tax will be reflected in the price of the Products present on the Website at the time of entry into force of the respective normative act. Any additional fees in respect of certain categories of Products sold on the Website at any time will be included in their price.

Placing the Order and concluding the sales contract

In order to place and register an order, the Customer must follow the instructions displayed on the Website in this regard. At the moment before order validation, the Customer will be provided with a summary of the information related to the order (number of items ordered, order amount, delivery type, delivery date and chosen time interval, as well as the address selected for home delivery), and this is validated by a "click" on the "CONTINUE" button.

Orders not validated by pressing the "CONTINUE" button will not be honored. Simply adding Products to the shopping cart does not amount to order validation and does not create any obligation for Acquirafresh to proceed with the delivery of the Products.

The website confirms the registration of the order by an automatic e-mail sent to the Customer, through which the following information will be communicated to him:

the list with the ordered items, the prices of the Products, the type of delivery, the address for home delivery;

shipping cost.

In this case, the sales contract will be considered to be concluded on the date of receipt, by the Customer, of the order registration confirmation.

Acquirafresh may request additional information about the order, including, but not limited to, the address and time of delivery of the order, if the information initially provided by the Customer is not sufficient to fulfill the order. In this case, the order will be validated and the sales contract will be considered concluded only on the date of receipt of the new information requested. In case of non-provision by the Customer of the additional information requested, the sales contract will not be considered validly concluded, Acquirafresh not having the obligation to honor the respective order.

Order validation does not guarantee the delivery of all Products in the placed order. If certain Products in the order become unavailable between the time the order is registered and the time of sending the confirmation e-mail which represents the acceptance of the order, Acquirafresh will notify the Customer, requesting the validation of the order without the Products becoming unavailable, by sending an e-mail confirmation of the Product list. In case of non-provision by the Customer of the confirmation of the list of Products without the Products that have become unavailable, the sales contract regarding the Products remaining in order and available will not be considered as validly concluded,four not having the obligation to honor that order.

There is no lower or upper limit on the value of orders that can be placed through the Website. However, if the Customer chooses to pay in cash the total value of the order, the respective value of the order will not be able to exceed the ceilings provided in Law no. 70/2015 for strengthening the financial discipline regarding the operations of cash receipts and payments and for amending and supplementing the Government Emergency Ordinance no. 193/2002 regarding the introduction of modern payment systems or in any other applicable normative act that regulates such ceilings.

The delivery cost is calculated according to the value of the Products ordered.

The customer has the opportunity to track the status of his orders on the Website by accessing the "My Account" section. The history of transactions made between Acquirafresh on the one hand, and the Client, on the other hand, can be consulted at any time on the Website under the heading "My Account".

Payment of Products

Payment for orders can be made in the following ways:

Payment on delivery - cash

Online payment by bank account

All amounts paid by an online Customer by card or by payment order for the purchase of Products through the Website will be transferred by the payment processing service provider to the Acquirafresh account.

All banking transactions on the Website will be performed in a secure manner, the payment processor being the guarantor of this security in terms of making online payments and undertakes to protect all personal data and information related to online payment methods.

In case of online card payments for the purchase of Products through the Website:

the processing is performed by the payment processor, Acquirafresh having no responsibility in this regard;

the payment amount for the order will be withdrawn from the card at the time of payment validation by the payment processor;

the delivery term of the ordered Product will start to run from the moment of confirmation of the payment made online with the card.

If the Customer chooses the option of payment on delivery (refund), payment will be made when the Products reach the delivery address.

If the Customer pays with the card, the processing is done by the payment operator.

If the Customer pays with a Payment Order, the payment is completed when the money enters the Acquirafresh account.

The customer guarantees to Acquirafresh that the use of the chosen means of payment does not violate any applicable law. Acquirafresh, reserves the right to suspend / cancel any order / delivery on which there are suspicions regarding any illegal or fraudulent action regarding the method of payment.

Acquirafresh reserves the right to suspend / cancel all orders / deliveries in case of refusal to make payment by financial-banking institutions (if the Customer has chosen to pay for the Products online or by payment order), without any compensation or notice. of Client.

All information entered in order to make an online payment (frame number, password, card validity date) will not be stored on Acquirafresh servers, but will be processed exclusively by the card issuing banking units.

The tax receipt will be issued for each individual order and will accompany the delivered Products. The tax invoice for an online order will be issued in electronic format and will be received and can be downloaded and printed no later than 4 days after receipt of the order. The tax receipt and / or invoice will be issued by the seller of the Products, Acquirafresh.

If a Product ordered by the Customer cannot be delivered by Acquirafresh for reasons beyond its control, Carrefour will inform the Customer accordingly and will return to the Customer's account the value of the product, within a maximum of 14 days from the date of which the Seller has acknowledged this fact.

Product Delivery

 The customer has the possibility to choose between the following methods of delivery of the Products:

The customer undertakes to be present upon receipt of the order at the address indicated in the order. If the Customer is not available to personally receive the order, he will designate another person in his place.

Reimbursement of the amount to the Customer will be made using the same method of payment as that used by the Customer to pay for the products, unless the Customer agrees to another method of payment. For the delivery of the products, the Customer can place a new order.

The customer has the obligation to verify the correctness of the information provided regarding the delivery address prior to order validation (street, street number, block / building, number, floor, intercom code, postal code). In case of errors in entering this information, Acquirafresh u will be held responsible for the impossibility of delivery of the order, late delivery of the order or for any other consequences.

Delivery of orders to the delivery address indicated by the Customer is provided by Acquirafresh, through the contractual partners - courier service providers - called "Couriers".

Deliveries will take place in the following time intervals that can be selected by the Customer:

08:00 - 15:00


08.00 - 13:00

At the request of Acquirafresh, or the Courier, the Customer will prove his identity, if necessary, by one or more documents issued by official authorities and will communicate the order number assigned by the sales system. Orders until 12 o'clock are delivered in the same day, after 12 o'clock in 24 hours.

If the Customer is unable to receive the order in person, the order will be delivered to the specified address only to a person over 18 years of age and only in the case of communication to the Courier of the order number.

No request for delivery of an order will be honored if the Customer does not meet the above conditions. In the case of delivery to a location chosen by the Customer, in the event that the Courier cannot have access to that location, the Customer must ensure that he can receive this order.

The customer or the person designated by him undertakes to be present at the delivery address indicated. Otherwise, the Customer will bear the shipping cost related to a possible new delivery. The time interval may be changed, after selection, only with the consent of the Courier. The delivery is considered to be fulfilled by Acquirafresh at the time of delivery of the Products ordered to the Customer at the address selected by him at the time of order validation.

The customer or the designated person undertakes to check the delivery, the condition of the Products and to sign the delivery document presented by the Courier upon delivery of the ordered Products, to which is attached the tax receipt containing all information about the Delivered Products (such as Product name, quantity, price).

Acquirafresh undertakes to respond to all requests and complaints within a maximum of 5 working days of receiving them.

In the event that the delivery date and time selected by the Customer cannot be observed, the Customer will be immediately informed by all means provided by the Customer, respectively by e-mail or SMS.

In case of delay in the delivery of the ordered Products, Acquirafresh advises the Customer to notify this delay by contacting the Customer Service in order to find the optimal solution for the delivery of the Products.

For delays in delivery of more than three (3) working days, except in cases of force majeure, as defined in the Terms and Conditions or impossibility of operation of the Website that did not allow viewing the order, the Customer is entitled to request cancellation of the order by an e-mail sent to comenzi@Acquirafresh.ro or to the telephone number of the Customer Relations Service in the "Contact" section.

 Right of withdrawal

Upon receipt of the goods, the Customer must ensure that the delivered products correspond in terms of quality and quantity to his expectations. a) According to GEO no. 34/2014, the withdrawal period (return of a Product) expires within 14 calendar days from:

➢ the day on which the Customer takes physical possession of the order - if all the Products that were the subject of the order were delivered in the same transport;

➢ the day on which the Customer enters into physical possession of the last Product - if the Customer orders through a single order Multiple Products that will be delivered separately;

➢ the day on which the Customer enters into physical possession of the last Product or the last part - in case of delivery of a Product consisting of several lots.

➢ if the price of the Product has been paid by the Customer, he will be reimbursed that price within 14 days from the date on which the Customer informs Acquirafresh of his decision to withdraw from the Contract, provided that the return is permitted by law.

➢ reimbursement of the amount will be made using the same payment methods as those used by the Customer to pay the price of the respective Product, unless the Customer agrees to another payment method.

➢ The customer will not pay any fees after the refund.

b) The amount paid will be reimbursed as follows:

➢ for Orders paid online by card and credit card in installments: by refund to the account from which the payment was made;

c) If the amounts due to the Client are reimbursed by transferring them to the Client's account, Acquirafresh will transfer to the Client's account, in addition to the amounts for the returned product (s), the amount of 4 lei meant to cover the amount of the bank collection fee the bank where the latter has opened the account. The amount of 4 lei indicated above was calculated by reference to the value of an average commission applicable on the market.

d) Acquirafresh reserves the right to defer the refund of the amount paid until receipt of the Products sold or until receipt of proof that they have been shipped, if he has not offered to recover the Products himself.

e) If the Customer requests the withdrawal from the contract within the legal term of withdrawal from the Contract, the only costs incurred by the Customer are the direct costs of returning the Product.

f) Reimbursement of the price of the Product will be made at the price entered on the sales document (fiscal receipt or fiscal invoice, as the case may be) related to the returned Product, regardless of its value fluctuations.

i) According to the legal provisions in force, the following may not be subject to the right of withdrawal:

➢ the supply of products that are likely to deteriorate or expire quickly;

➢ the supply of sealed products which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer;

j) The products marked in the return form must be handed over in full to the courier, exactly as they were ticked on the Website upon request for return. If there are different products in the return package than those in the completed form, after checking the package by the courier, the pick-up will be refused.

k) In case of returning the products, the Customer is responsible only for the decrease in the value of the products resulting from their handling, different from what is necessary to determine the nature, characteristics and operation of the products. The returned product must be accompanied by all the documents with which the product was delivered

Wrongly delivered products

If the Customer has been delivered a Product other than the one ordered or if the Customer has been delivered a Product that the Customer has not ordered, the Customer is asked to report this to Customer Service as soon as possible to return the Product and replace it with correct, if applicable.

All costs of return and transport of the Product, as well as costs related to the delivery of the ordered Product (if applicable) will be borne by Acquirafresh.


In addition to the legal guarantee of conformity, the commercial guarantee granted by Acquirafresh, it is possible that some Products benefit from the commercial guarantee granted by the manufacturer.

Acquirafresh will indemnify the Customer for direct damages created as a result of (i) breach of these Terms and Conditions, (ii) culpable actions committed with intent or gross negligence by its own employees. In these two cases, the remedies provided for in these Terms and Conditions shall apply as a matter of priority.


i. All force majeure events defined by Romanian law represent a reason to suspend and extinguish Acquirafresh's obligations.

ii. Neither party will be liable for non-performance of its obligations under these Terms and Conditions, if such failure to perform on time and / or properly, in whole or in part, is due to an event of force majeure. Force majeure is any external event, unpredictable, absolutely invincible and inevitable.

iii. If within 15 (fifteen) days from the date of its occurrence, that event does not cease, each party shall have the right to notify the other party of the cancellation of the order, without either of them being able to claim damages from the other.

vi. Acquirafresh cannot be held liable in these cases of force majeure.


These Terms and Conditions are subject to Romanian law. In case of disputes, the Customer will be able to submit complaints to the Customer Service to reach an amicable settlement. However, in the event that no amicable settlement has been reached between the parties, the disputes will be settled by the competent courts.
